Terms of Service

Kasumi is a company incorporated under the laws of Mexico. The legally binding version of these Terms of Service is the Spanish version (Términos y Condiciones). This English translation is provided for informational purposes only and does not constitute a legal agreement. In the event of any discrepancy between versions, the Spanish version shall prevail.
These Terms and Conditions govern the relationship between Kasumi ("Kasumi", "we", or "the Platform") and any individual or legal entity that accesses or uses the services offered through the platform available at app.kasumi.cx (the "Client" or "User"). By registering, accessing, or using the Platform, the Client expresses their acceptance of these Terms.
1. Definitions
- Platform: The software as a service (SaaS) provided by Kasumi, accessible at app.kasumi.cx.
- Client / User: Any individual or legal entity that registers and uses the Platform.
- Account Owner: The primary user who creates the account, assumes financial and legal responsibility, and has full control over settings and associated users.
- Additional Users: Individuals authorized by the Owner to access the Platform under the same account, with admin or agent roles.
- Subscription: The plan contracted by the Client granting access to Platform features during the paid period.
- Trial: A 7-day trial period with full access to all Platform features, subject to an activation fee.
- Integrations: Connections with third-party services, including the official WhatsApp Business API provided by Meta Platforms, Inc.
- Content: Any data, messages, files, templates, or information that the Client uploads, sends, or processes through the Platform.
2. Description of Service
Kasumi provides a WhatsApp-specialized CRM platform that includes:
- Unified inbox for WhatsApp Business conversations
- Visual workflow management (Kanban boards)
- Bulk WhatsApp campaigns with performance metrics
- AI-powered template generation and management
- Analytics dashboards with 74+ metrics
- AI agents for conversation automation
- Contact management and sales pipeline
- Multi-agent team collaboration
Services are provided through integrations with Meta's official WhatsApp Business API. The operation of such integrations depends on the availability and policies of Meta Platforms, Inc., over which Kasumi has no control or responsibility.
3. Roles and Account Ownership
The Account Owner is solely responsible for financial and legal obligations. The Owner may create and manage Additional Users with different access levels (admin, agent). The Owner is responsible for all activities performed by Additional Users under their account.
Each Client may have only one account associated with their email address. Creating multiple accounts to circumvent restrictions or service limits is prohibited.
4. Registration and Account Use
To use the Platform, the Client must register by providing truthful, complete, and current information. The Client is responsible for maintaining the confidentiality of their login credentials and for immediately notifying Kasumi of any unauthorized use of their account.
The Client must be at least 18 years old or have the legal capacity to enter binding contracts. When registering on behalf of a legal entity, the Client represents that they have the legal authority to bind such entity.
5. WhatsApp Business API Compliance
By using Kasumi, the Client agrees to comply with:
- WhatsApp Business Policy
- WhatsApp Commerce Policy
- Meta's Platform Terms
- Meta's Privacy Policy
Kasumi shall not be liable for any suspensions, restrictions, or cancellations of the Client's WhatsApp Business account by Meta, nor for service interruptions attributable to Meta or third parties.
6. Subscriptions and Payment Terms
6.1 Trial
Kasumi offers a 7-day Trial with full access to all Platform features, subject to an activation fee of $9 USD (or its MXN equivalent). At the end of the Trial period, the subscription will automatically convert to the current Core Plan unless the Client cancels before the Trial expires. Kasumi will send a reminder email at least 48 hours before the automatic conversion, informing the Client of the upcoming charge and providing instructions to cancel if desired.
6.2 Core Plan
The Core Plan includes access for 3 users, unlimited WhatsApp lines, and all Platform features. The base price is $99 USD/month (or its MXN equivalent). Each additional user costs $15 USD/month (or its MXN equivalent).
6.3 Founding 100 Program
The first 100 clients who convert from Trial to subscription will receive a preferential rate of $79 USD/month (or its MXN equivalent) for life, representing a 20% discount on the Core Plan price. This rate will remain in effect as long as the subscription remains active and uninterrupted.
6.4 Billing
Subscriptions are billed monthly in advance. Charges are processed automatically using the Client's registered payment method on the corresponding date of each billing cycle. Prices are displayed in Mexican Pesos (MXN) for Latin American clients and in US Dollars (USD) for other regions.
6.5 Non-Payment
If automatic billing fails, the Client will have a grace period of 5 business days before the account is suspended. During suspension, access to the Platform will be restricted. Account reactivation will occur within 1 business day after successful payment processing.
6.6 Price Changes
Kasumi reserves the right to modify plan pricing. Changes will be communicated to the Client at least 30 days before the start of the next billing cycle. If the Client disagrees, they may cancel before the new pricing takes effect.
6.7 No Refunds
Subscription fees are non-refundable. The Client shall not be entitled to any refund or compensation for early cancellation, unused subscription periods, or dissatisfaction with the service, except as required by applicable law.
7. Cancellation
7.1 Cancellation by the Client
The Client may cancel their subscription at any time through their account settings on the Platform. Upon cancellation, the Client will retain access until the end of the current billing period. No refunds are provided for partial periods.
7.2 Cancellation or Suspension by Kasumi
Kasumi reserves the right to suspend or cancel the Client's account, without prior notice, in the event of:
- Violation of these Terms or Meta/WhatsApp policies
- Use of the Platform for illegal or fraudulent activities
- Sending unsolicited messages (spam) through the Platform
- Non-payment beyond the established grace period
- Any activity that poses a risk to the security or stability of the Platform
8. Acceptable Use
The Client agrees not to use the Platform to:
- Send spam, unsolicited messages, or prohibited content
- Violate any applicable laws or regulations, including Mexican law and the laws of the Client's country of residence
- Infringe on third-party intellectual property rights
- Transmit malicious code, viruses, or interfere with Kasumi's systems
- Attempt unauthorized access to the Platform, other accounts, or related systems
- Resell, sublicense, or redistribute access to the Platform without written authorization
- Extract data from the Platform through unauthorized scraping, crawling, or automated methods
9. Intellectual Property
All intellectual property rights in the Platform, including software, design, logos, trademarks, and documentation, belong to Kasumi. The subscription grants the Client a limited, non-exclusive, non-transferable, and revocable license to use the Platform during the active subscription period.
Content uploaded or processed by the Client through the Platform remains the Client's property. Kasumi does not acquire ownership rights over such Content but may process it as necessary to provide the contracted services.
10. Treatment of Data Stored in the CRM
Regarding the processing of personal data belonging to the Client's end customers (WhatsApp contacts, conversations, message history, and other information managed through the Platform):
- The Client is the Data Controller for the personal data of their own customers and contacts, under the LFPDPPP. The Client is solely responsible for obtaining the necessary consent from their end customers for data processing through the Platform.
- Kasumi acts as the Data Processor, processing such data exclusively on behalf of the Client and for the purposes of delivering the contracted service.
Client Obligations as Data Controller
- Have the appropriate consent or legal basis for processing their end customers' data
- Provide their end customers with a privacy notice compliant with the LFPDPPP
- Not upload or process sensitive personal data of third parties without their express written consent
- Comply with ARCO rights requests from their own end customers
- Notify Kasumi of any deletion or rectification requests involving data stored on the Platform
Kasumi Obligations as Data Processor
- Process CRM data solely according to the Client's instructions and for service delivery
- Not use CRM data for its own purposes, marketing, profiling, or any purpose other than Platform operation
- Not access the content of the Client's WhatsApp conversations except when strictly necessary for technical support and with the Client's consent
- Implement the technical and organizational security measures described in these Terms and the Privacy Policy
- Delete CRM data after account cancellation, in accordance with the established retention period
11. Post-Cancellation Data Retention
After account cancellation, Kasumi will retain the Client's data in cloud storage for a period of 90 days. During this period, the Client may request a data export by contacting support@kasumi.cx. After this period, data will be permanently deleted. Kasumi does not guarantee data restoration after deletion. Clients are advised to export their data before cancellation.
12. Service Quality and Warranties
The Platform is provided "as is" and "as available". Kasumi makes no warranties, express or implied, regarding uninterrupted availability, accuracy of AI-generated analytics, or suitability for the Client's specific needs. Results generated by AI agents are advisory and do not constitute professional advice.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Kasumi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data loss, business interruption, or loss of business opportunities.
If Kasumi is found liable by a final court judgment, Kasumi's total liability shall be limited to the amount of the last monthly payment made by the Client.
Kasumi shall not be liable for failures, interruptions, or limitations in integrated third-party services, including Meta's WhatsApp Business API, hosting services, or payment processors.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Mexican States (Mexico), including the Commercial Code, the Federal Civil Code, and other applicable legislation. For any dispute arising from these Terms, the parties submit to the jurisdiction of the competent courts of Querétaro, Querétaro, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
15. Modifications to Terms
Kasumi reserves the right to modify these Terms at any time. Material changes will be communicated to the Client via email or through a notice on the Platform at least 15 days in advance. Continued use of the Platform after changes take effect constitutes acceptance of the new Terms. If the Client disagrees, they must cancel their subscription before the changes take effect.
